3. Who Will Obtain Your Personal Information and Cross-Border Transfer of Personal Information

Coupang Taiwan Co., Ltd. (hereinafter referred to as “we”, “us”, “our”) collects, processes and uses your personal information on the legal bases of “contractual relationship”, “consent”, and “legal requirement”.

The purpose of this Privacy Notice is to comply with Taiwan’s Personal Data Protection Act and relevant regulations, and to explain how we collect, process, use, transfer, and protect your personal information.  You may choose to read the entire document or focus on specific sections of interest by referring to the headings provided above.

1. What Personal Information We Collect

 1 . 1 To achieve the purpose of personal information collection, we will collect the following personal information from you:

  • Identity and characteristic information – name, account, password, gender, contact information, residency, national id number, vehicle license plate number;
  • Driver’s license number and photocopy or electronic file of the license;
  • Bank account information;
  • CCTV footage;
  • Location information within the App;
  • Emergency contact name and phone number (you must ensure that you have the right and legal authority to provide the third party’s information and have informed the third party to read this notice); and
  • Information you choose to voluntarily provide.

2. Why We Collect and How We Use Your Personal Information

Unless an exception applies, we collect, process and use your personal information for the purposes of fulfilling contractual or legal obligations, personnel management, business communication, surveys and analysis, marketing, and security management of premises. For example:

  • Phone number and email for business communication and marketing, such as notifying order information, business guides, sending withholding tax receipts or settlement statements, reward activities, and communicating other necessary business information;
  • Residency and ID number for income declaration;
  • ID number is also used for identity verification to avoid duplicate registration and for financial institutions to verify identity when disbursing settlement payments;
  • License plate number (and name or contact information) for verifying the vehicle receiving orders and registering personnel entry and exit;
  • Driver’s license information for confirming contract performance qualifications;
  • Bank account information for disbursing settlement payments;
  • CCTV footage for ensuring the safety of premises, personnel, and property;
  • Location information within the app for managing premises entry and exit, and providing route information for goods delivery;
  • Contacting the emergency contact you provided in case of an incident;
  • When you make inquiries, seek support, or file complaints, we will use your contact information to communicate and respond, and use the communication records to confirm the appropriateness and accuracy of the communication process;
  • We will periodically arrange surveys or interviews with you to gather valuable suggestions for our services; 
  • To ensure account security, we may use data recorded within the app (e.g., IP address, device information) to identify or alert suspicious account login behavior; and
  • When we are legally obligated to submit information (e.g. income declaration, infectious diseases reporting, administrative inspection or criminal investigation), or when we exercise our rights (e.g., legal proceedings for contract disputes), we may need to provide your personal information to necessary third parties (e.g., competent authorities, judicial authorities).

3. Who Will Obtain Your Personal Information and Cross-Border Transfer of Personal Information

To achieve the purpose of collecting personal information or to comply with legal requirements, we may store your information abroad or provide it to third parties in specific circumstances.  For example:

  • Your information will be stored in the AWS cloud space managed by our affiliated company in South Korea (with backups in Singapore) and accessed within the scope of the purposes of collection by our employees and the Korean-affiliated business team entrusted to support the execution of our business;
  • Financial institutions will obtain your personal information to disburse settlement amounts;
  • When we use the survey system provided by our service providers, your information will be stored in the provider’s storage space in Australia; and
  • Other legally designated recipients (e.g. tax authorities, health authorities, competent authorities, judicial authorities, etc.).

 

4. The Duration of Our Utilization/Retention of Your Personal Information

 4 . 1  We will use personal information for the entire duration needed to serve the purposes listed in Article 2. Upon the achievement of these purposes or if they cease to exist (for instance, when the contract is terminated), we will stop using your personal information for such purposes. However, if there is an open case at the time of termination, it will continue to be used for a period of 60 days from the date of termination until the completion of the case, which may be extended if necessary.

 4 . 2 Unless one of the following circumstances occurs, we will delete, destroy, or anonymize your personal information in an irreversible manner or render it unidentifiable upon the complete cessation of the specific purposes for which we collected your personal information:

  • The statutory period for retention;
  • A reasonable presumption that the deletion of information will infringe your protectable interests;
  • Legitimate justification suggesting that the information cannot be deleted; and
  • Your written confirmation not to delete the information

5. What We Do to Protect the Safety of Your Personal Information

 5 . 1 In order to prevent personal information from being stolen, altered, damaged, loss, leaked, or infringed in any other form, we take various management schemes and technical measures to safeguard the security of your personal information. For instance:

  • Conduct periodic internal audits of information security and set up maintenance plans to ensure the information protection measures effectively function;
  • Implement security solutions, such as intrusion prevention systems, to prevent unauthorized external personnel from accessing and using the personal information;
  • Keep records of the personal information usage history and establish measures to prevent tampering or alteration of such records;
  • Encrypt personal data and any substantial data (such as passwords) during transmission;
  • Implement a system that is capable of identifying and preventing network intrusion attempts, can be monitored for 24 hours, and install antivirus software to prevent computer virus attacks;
  • Grant access to personal information exclusively to employees under specific duties and on a need-to-know basis; and
  • Conduct periodic privacy and security obligation education training for employees handling personal information.

 5 . 2 However, given the nature of the online environment, we cannot guarantee absolute security, and thus we remind you to diligently safeguard the security of the devices, equipment, and login information you use. This is to prevent unauthorized access, illegal usage, acquisition of login information, alteration of basic personal information, and destruction of records by others.

 

6. The Rights You Can Exercise and How to Exercise Them

 6 . 1 According to the Personal Data Protection Act, you may exercise your rights in terms of your personal data with us. We will fulfill your request within the statutory time period unless an exception stipulated by law applies:

    • The right to make an inquiry or access (completed within 15 days of acceptance: Should there be a necessity to extend the period, a written notice stating the reasons may be issued to extend the period by a maximum of 15 days);
    • The right to request a copy (completed within 15 days of acceptance; should there be a necessity to extend the period, a written notice stating the reasons may be issued to extend the period by a maximum of 15 days.);
    • The right to make a correction or update (completed within 30 days of acceptance;Should there be a necessity to extend the period, a written notice stating the reasons may be issued to extend the period by a maximum of 30 days.);
    • The right to suspend the collection, processing or use (completed within 30 days of acceptance; Should there be a necessity to extend the period, a written notice stating the reasons may be issued to extend the period by a maximum of 30 days.); and
    • The right to delete your personal information (completed within 30 days of acceptance; Should there be a necessity to extend the period, a written notice stating the reasons may be issued to extend the period by a maximum of 30 days.)
