Rocket Overseas Terms of Use

1. Use of Rocket Overseas Services

1.1 Coupang Taiwan Co., Ltd. (“Coupang Taiwan” or “we”) provides e-commerce services through the Rocket Overseas Services, so that offshore sellers who have entered into global seller agreements with us (“Offshore Seller”) can publish product sales information on the Rocket Overseas Services. Detailed information can be found on the product details pages.

1.2 After you place an order on Coupang E-commerce through the Rocket Overseas Services, we will be pass your order via Coupang E-commerce to Offshore Seller on your behalf, thereby facilitating the conclusion of the product sale and purchase contracts in accordance with the terms mutually agreed by both parties. In addition to the operation, management, and provision of Coupang E-commerce, Coupang Taiwan will provide necessary assistance to ensure the smooth delivery of products from Offshore Seller to you.

1.3 All the pictures, descriptions and other related information about products, including advertisements, as published in the Rocket Overseas Services, are provided, uploaded and published by Offshore Seller. Since Coupang Taiwan is not a party to the transaction, it is unable (nor does it aim) to screen or review the contents thereof in advance. You are responsible for determining whether the information is authentic, credible, legitimate, or up-to-date. To the extent permitted by law, you will be solely responsible for any and all liabilities and disadvantages arising from such information.

1.4 The Rocket Overseas Services may contain translations of product information and customer reviews powered by Google, which should not be deemed as translations provided by Coupang Taiwan. Coupang Taiwan and Google disclaim all representations and warranties related to the translations, express or implied, including any representations or warranties of accuracy, reliability, and any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Translations are provided on an “as is” and “as available” basis, and some content (including text and images) may not be accurately translated due to the limitations of the translation software. The actual description should be those on the product specification.

1.5 Before purchasing products, you should thoroughly verify the details of the products and transaction conditions stated by Offshore Seller within the Rocket Overseas Services. For example, electronic products’ electrical plugs, outlets, voltage, or other specifications and warning messages are designated for use internationally and may differ to the standards in Taiwan. Any impracticable products or damages incurred due to a purchase without verifying these details and transaction conditions will be solely your responsibility.

1.6 You are responsible for ensuring that the transaction you make, including the importation of the purchased product, complies with applicable laws and regulations. If the transaction you made is likely in violation of applicable laws and regulations, the Rocket Overseas Terms of Use, the Coupang Terms of Use or other applicable terms, contrary to public order or good morals, may infringe upon any third party’s rights or interest, or if your use of Coupang Cash does not comply with or is not allowed in accordance with the Coupang Terms of Use, we may, at our discretion, restrict your use of the Rocket Overseas Services, retrieve or cancel of Coupang Cash, restrict the use of Coupang Cash, or cancel your transaction according to Offshore Seller’s instructions.

1.7 In certain situations, we may request you or the recipient designated by you (“Recipient”) to undergo specific procedures, including age and identity verifications, to comply with applicable laws and regulations, or to pay additional administrative fees and reasonable handling charges for the importation of certain products. For example, to import the product you purchased, the Recipient, acting as the importer of record, will need to sign up for an account and complete the real-name authentication and/or submit a letter of authorization through a mobile application named “EZ WAY” (which needs to be linked to the Recipient’s mobile numbers) or a website named “E-commerce Customs Clearance Platform” (which needs to be linked to the Recipient’s Citizen Digital Certificate IC card using a card reader) in accordance with relevant customs regulations. Failure to complete such real-name authentication and/or submit a letter of authorization may affect the completeness and efficiency of the checkout and importation procedures. You agree that you will not request any refund on the grounds that customs clearance was not completed due to incomplete verification of your real name or failure to submit an authorization letter.

1.8 The Recipient is the importer of record for any products you purchased through the Rocket Overseas Services, and it is your and the Recipient’s obligation to comply with the relevant importation procedures, licenses, restrictions, inspections, certifications, and other requirements (including limitations on imports for personal use; collectively, “Import Rules”). You and/or the Recipient will be solely responsible for all losses, damages, and fees resulting from any non-compliance with the Import Rules. Furthermore, if the Customs, in accordance with the Import Rules, decides to inspect, request your confirmation with evidence, or temporarily hold in custody the products you purchased through the Rocket Overseas Services, and you decide to cancel your orders in whole or in part, you and the Recipient must cooperate by submitting documents declaring the abandonment of the products or agreeing their destruction.

1.9 You understand that if any dispute arises from the transactions, it is Offshore Seller’s responsibility to resolve such dispute with you. However, to ensure a smooth purchase experience, Coupang Taiwan will provide assistance that we deem necessary and appropriate, or may, at our discretion, intervene to resolve disputes if we deem such intervention necessary.

2. Conclusion of Sales Contract

2.1 Unless otherwise stipulated in these Rocket Overseas Terms of Use, Offshore Seller may, at its discretion, accept or decline the order you placed through the Rocket Overseas Services. If Offshore Seller accepts your order, an electronic confirmation of acceptance will be available on your Coupang E-commerce account page. At this point, a conditional product sale and purchase contract will be concluded for the product you ordered. The formation and performance of this contract are subject to the condition that your order does not violate the terms of the agreement between you and Offshore Seller, the Rocket Overseas Terms of Use, the Coupang Terms of Use, or other applicable terms. If Offshore Seller identifies any breach of the foregoing, it is entitled to instruct us to cancel your transaction in accordance with the applicable terms and conditions.

2.2 Coupang Taiwan aims to manage various facilities and materials, and to verify whether the Rocket Overseas Services are being used for their intended purposes, to ensure the safe provision of the Rocket Overseas Services. If you are found to have violated the intended purposes, we may request an explanation from you and take necessary actions, such as canceling your order to Offshore Seller, regardless of whether it has been accepted by Offshore Seller or not.

2.3 Coupang Taiwan may cancel a transaction under Offshore Seller’s instruction without your consent if the purchase price is not paid within a specified time period after the order is placed.

3. Delivery of Products

When a product sale and purchase contract is concluded, Offshore Seller will aim to deliver the product to you in accordance with the estimated delivery time and method (including delivery in separate parcels based on shipping constraints) set forth on the order confirmation page. A delivery fee will be charged as indicated on the order confirmation page. While the estimated delivery time displayed when you place an order provides an estimate, the actual delivery time may vary depending on weather, transit congestion, order volume, and other conditions.

4. Payments

4.1 The amount you actually pay will be the remaining amount (actual purchase price) after applying to the original price (set by Offshore Seller), any applicable discount coupons, delivery fees, Import Fees (as defined below), and other charges. If you choose to pay by credit/debit card, your card issuing company may charge additional foreign transaction fees and processing fees, which are payable to your card issuing company and will not be indicated during the checkout process.

4.2 Payment of the product price, delivery fee, and Import Fees will be made using the payment method of your choice from the options designated by us. You are solely responsible for entering correct information and for any and all liabilities and disadvantages arising from the information you entered in relation to the payment.

4.3 You may be subject to applicable fees resulting from importation, such as import taxes, business taxes, excise taxes, fees, and customs duties (collectively, “Import Fees”), levied by the Customs office of Taiwan. Components that play a role in Import Fees calculations include, but not limited to:
(1) Product category, quantity, and price;
(2) Shipping costs and package weight;
(3) Shipping method and customs clearance channel; and
(4) Import taxes based on customs values.

4.4 An estimate of the Import Fees (“Import Fees Deposit”) will be levied on all applicable items in your order at checkout. The Import Fees Deposit will be used to settle the Import Fees with the relevant authorities. The payment of the Import Fees Deposit is your responsibility.

4.5 The Import Fees Deposit is an estimation of the taxes, duties, and fees that may apply. The Import Fees Deposit for each individual order is calculated during checkout and may be specified in the order summary. The Import Fees Deposit may not represent the actual Import Fees. There is a possibility that Customs regulations and tax rates applicable to certain goods may change between the date the Import Fees Deposit was estimated and the date of import into the destination country. Additionally, the Customs office may have a different estimate of the amount of payable Import Fees.

4.6 If the actual Import Fees are less than the Import Fees Deposit you paid, you will be refunded the difference to the payment method used for the order. The refund will be processed after the carrier/broker confirms the actual Import Fees. The refund date is contingent on the processing time of the carrier/broker and your credit card issuer.

5. Title Transfer

Title to every product purchased through the Rocket Overseas Services will transfer from Offshore Seller to you (or the Recipient) upon the handover of the product to you (or the Recipient), or when the product is placed at the location you have designated (including the “leave it at the door” or “CVS pick-up” option), except for transactions that have been cancelled due to your violation of the applicable terms and conditions.

6. Returns, Refunds and Exchanges

6.1 The requirements related to returns, refunds, and exchanges of products may vary depending on the location and categories of the products. Please refer to the product details pages where the product is displayed for the policies related to returns, refunds, and exchanges. To provide you with a better customer experience, Coupang Taiwan will offer assistance where we deem necessary and appropriate to support your request for the return, refund, or exchange of products.

6.2 In certain situations indicated on the product details pages, the Import Fees may not be refunded even if Offshore Seller agrees to your request to return a product. You may need to file for any refund of custom duties or taxes levied by the Taiwan Customs and government authorities. Please consult your tax advisor if you wish to seek any refund of Import Fees.

7. Receipt

If you require a product purchase receipt, we recommend that you confirm its availability with Offshore Seller before the transaction. We will not be able to issue such receipts on behalf of Offshore Seller. As this is a cross-border transaction, we will not issue government uniform invoices (“GUIs”) for the purchase price that you paid. Offshore Seller who is not a Taiwan company will not be able to issue GUIs to you.

8. Changes and Relation with Other Terms of Use

These Rocket Overseas Terms of Use took effect on June 21, 2022, and were last updated as stated above. You understand that when using the Rocket Overseas Services, you must also comply with the Coupang Terms of Use and other applicable terms. If there is any inconsistency between these Rocket Overseas Terms of Use and the Coupang Terms of Use or other applicable terms, to the extent of the inconsistency, these Rocket Overseas Terms of Use will control your use of the Rocket Overseas Services.
